Hemp Ban Extended, Now the Real Fight Begins
In our latest Trade to Black podcast, presented by Flowhub, hosts Shadd Dales and Anthony Varrell sit down with Jim Higdon, co-founder and chief communications officer of Cornbread Hemp, to unpack this week’s big development — the House clearing the hemp ban extension and moving the deadline from November 12 out to December 11.
The headline vote wasn’t close at 370–48, but the friction showed up elsewhere. A faction of hemp opponents led by Andy Harris tried to register their protest through an unrelated procedural rule vote, which scraped by at 210–208 only after two Democrats broke ranks. Jim lays out what the delay actually changes for hemp operators day to day, and why the coming stretch of roughly 100 days raises the stakes considerably as Congress tries to land a durable framework before the new deadline. He’s also clear that synthetic cannabinoids were left out of the reprieve and are still headed for a ban.
Several competing bills are already circulating, and Jim walks through how they differ. Andy Barr’s Lawful Hemp Protection Act would keep the industry legal while setting federal guardrails on how products are made, tested, labeled, taxed, and age-restricted. James Comer, who chairs House Oversight, has floated a narrower approach centered on packaging, testing, and age limits. And a bill from Beth Van Duyne and Greg Landsman zeroes in on hemp THC beverages specifically, treating them much like alcohol for regulatory and tax purposes. Jim gives his honest read on which of these has real traction, what operators should be doing now to get ahead of it, and what he thinks a plausible December outcome looks like.
He also gets into why he bristles at the “synthetic” label being used as a cudgel, why THCA flower and inhalable products look like the toughest sell in any final deal, the role alcohol distributors are starting to play, and a telling detail about his own customer base — a majority of Cornbread’s gummy buyers are over 65, most just chasing better sleep and relief from pain.
