HHS Declines Invitation to ALJ Hearing for Rescheduling

In this episode, Shadd and Anthony discuss why the US Department of Health and Human Services (HHS) declined a request from the DEA to provide witnesses for the upcoming ALJ hearing for cannabis rescheduling on December 2. As reported by Marijuana Moment, the HHS—responsible for conducting the scientific review that led to the rescheduling proposal—declined the DEA’s invitation to have any of its staff testify on December 2, 2024 at the Administrative Law Judge (ALJ) hearing. The DEA and ALJ retain the ability to subpoena HHS, but it is uncertain whether they will take this step.

It’s just another example of how adversarial the relationship between the HHS and DEA is. We discuss the main reasons behind their decision to decline and whether this choice could have any ramifications.
